Mason’s Travel (Pty) Ltd is a company incorporated and existing under the laws of Seychelles with its principal place of business the Mason’s Travel Head Office located in Michel Building, Revolution Ave, Victoria, Mahé.

At Mason’s Travel (Pty) Ltd, and our affiliates and branch offices (collectively referred to as “Mason’s Travel”, ”we “,”us “), we take our data protection and privacy responsibilities seriously. This statement describes how we collect, process, use, disclose and transfer your personal information as a data controller. It covers instances when you contact us, use our services or interact with our website www.masonstravel.com

 

This website www.masonstravel.com (“Website”) is made available to you by Mason’s Travel (Pty) Ltd hereinafter referred to as “Mason’s Travel”, “we” or “us”. We comply with data protection legislation such as the EU General Data Protection Regulation, which regulates the processing of personal data relating to you and grants you various rights in respect of your personal data. The aim of this Privacy Policy is to inform you about how we will use your personal data you provide to us, as well as personal data provided and/or collected by us through other channels. We also inform you about your rights under applicable data protection law with respect to the handling of your Personal Data by us. Before providing us with Personal Data we recommend that you read this Privacy Policy which also forms part of our Terms and Conditions that govern our services.

 

I. What is Personal Data?

For the purposes of this Privacy Policy, “Personal Data” means any information provided by you when interacting with us, for example through our Website or when calling us, or data is collected about you through your use of our Website and allowing you to be identified personally, either directly (e.g. your name) or indirectly, because the data references an identifier such as your name, an identification number, location data, an online identifier (e.g. telephone number) as an individual person. We may also collect personal data about you in other instances which relate to your use of our services.

 

II. When is personal data stored and processed? For what reason?

  1. Use of the Website

Whenever you navigate our Website, data about you is collected and processed. We collect the following data:

  • Country you are browsing from
  • Browsing habits, including sites visited

  • Marital status, and
  • Other demographics and statistical information

The data is collected through the session cookies (with regard to cookies see also below) we use on our Website. It is anonymised before we use it to build anonymous utilisation profiles, for marketing purposes and to optimise our Website and the services we provide. This data shall not be used in order to identify the visitor of this Website personally.

  1. Interacting with us

Every time you interact with us (e.g. booking a room through our online platform, by phone or through a third party provider, posting a comment on our blog, signing up for our newsletter) we may collect and process the Personal Data you provide to us.

 

a) Using our online platform or making a tour reservation

When you use our online booking platform (online.masonstravel.com), we collect Personal Data, which includes:

  • Your selected hotel
  • Your selected dates
  • Number of rooms in the reservation
  • Number of people in the reservation (adults and children)
  • Age of children
  • The rate/special offer selected
  • Any add-on packages selected
  • Your full name
  • Your address, including city and country
  • Your e-mail address, and
  • Your credit card details

Optional information

  • Arrival Information
  • Room, Bed type and/or other preferences
  • Telephone/mobile

We use this Personal Data to handle your reservation and to establish and fulfil our contract with you. This includes verifying your identity, taking guarantee and/or payment information, and sending stay-related and/or marketing communication.

When you are making a booking on behalf of other travelling passengers, it is your responsibility to represent that passenger in the booking process and explain how we will use their personal information as stipulated in this Privacy Statement. You must obtain their consent to make the booking and share their details with us as anticipated by this Privacy Statement. We will assume that you have done this. We may be under separate legal obligations to explain to them that we are controlling their personal information, even if it comes to us from you.

We take the protection of your Personal Data very seriously and therefore have kept the mandatory required fields to a minimum.

 

b) Newsletter and special offers

If you provide your contact information to us (e.g. when booking a service with us or when signing up for our newsletter via our Website), we may use this Personal Data to send you our newsletters and details of other special offers which may be of interest to you, based on previous interactions with us (e.g. bookings).

If you sign up for our newsletter via our Website, you are required to provide your email address only. Any additional information is voluntary and will be used solely for a personalisation of the newsletter.

By providing your email address and subsequent confirmation, you consent to receive our newsletter. You can revoke your consent and opt out of receiving the newsletter at any time by clicking on the unsubscribe link included in every newsletter. For any further objections, kindly address the contact stated at the end of this policy.

Our email newsletters are created and sent using Mailchimp®, where our mailing list is stored and collated. Please kindly note that Mailchimp® independently controls your Personal Data which is stored on this platform, i.e. how they process your Personal Data lies solely within their responsibility. We do not have influence on the collected data and data processing operations conducted by Mailchimp®. Information on the purpose and scope of data collection and its processing by Mailchimp® can be found in the respective data protection policies of this Provider, where you will also find further information on your rights and options for privacy protection. 

We also include web beacons in HTML-formatted e-mail newsletters in order to count how many newsletters (or particular articles, links, etc.) are being accessed, and on our website to count users who have visited these pages.

 

c) “Contact Us” functionality

You can get in contact with us via our Website by using the “Contact Us” functionality, or by telephone. To contact us you may be required to provide the following information:

  • Your full name
  • Your country
  • Your telephone number and your e-mail address,
  • Your enquiry, and
  • Recaptcha, to confirm you are an actual person, and not a robot

Any additional information (e.g. home address) is provided voluntarily.

We use your information to reply to your enquiry.

 

d) Communication Providers

You can also get in contact with us via different communication channels (such as Twitter, Facebook, Instagram etc., hereafter referred to as “Communications Provider”) if  you have any enquiries which you would like us to address. You will find an overview of the respective Communications Provider through which you can get in contact with us (i) in our pre-arrival communications with you, (ii) on the landing page of our central communications hub (iii) on leaflets including this information, which we may provide to you. Please kindly note that those Communications Provider independently control your Personal Data which is being communicated on these channels, i.e. how they process your Personal Data solely lies within their responsibility. We do not have influence on the collected data and data processing operations conducted by such Communications Provider. e) Mason’s Travel Blog

In our Travel  Blog, we publish articles on travelling and Seychelles Travel Industry news. The blog allows you to post public comments. If you submit a comment, it will be published with the corresponding blog post and your username. Posting comments on our blog is entirely voluntary.

When you comment on a blog post, we collect and store the following Personal Data:

  • Name
  • Website URL
  • Your Comment

We use this Personal Data to post the comment on the blog page.

 

III. Sharing Personal Data

Your Personal Data may be shared:

  • Between Mason’s Travel departments to establish and fulfil our contract with you or to the extent you consented to such sharing of data, for example. This includes verifying your identity, taking payments getting in contact and communicating with you.
  • With our commercial partners in the event that you book an event, service or an activity organised by such commercial partners.
  • With our third party service providers who process your data on our behalf. Mason’s Travel’s third party service providers hosting providers (including GoDaddy Web Services), and providers of data analysis, IT services, and other similar services requested by Mason’s Travel to provide the Website and other business-related services to you. Any data processing on our behalf complies with the applicable laws.

We will not transfer your personal data to third-party recipients unless you consent to such transfer of data or such transfer is permitted under applicable law.

 

IV. Transfer of Personal Data

Where information is transferred, we will ensure that appropriate safeguards are implemented. If your Personal Data is transferred to a country that is not subject to an adequacy decision by the EU Commission, data is adequately protected by EU Commission approved standard contractual clauses, an appropriate Privacy Shield certification or a third party’s Binding Corporate Rules.

VI. Integration of YouTube videos

We have included a link to our YouTube channel on our Website. The videos are stored on http://www.YouTube.com, operated by YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. Your Personal Data will not be transferred to YouTube unless you play the videos. We have no influence on this data transfer. IX. What kind of security measures for the compliance with data protection?

We strive to maintain the appropriate standards of security and we have put in place robust technical and organisational measures for the protection of your Personal Data in accordance with the current state of the art technologies, especially to protect the data against loss, falsification or access by unauthorised third persons. For the transfer of particularly sensible Personal Data via the internet, such as for example credit card details, we exclusively use encrypted transmission routes and we comply with the Payment Card Industry Data Security Standards (PCI DSS) which is a set of policies and procedures intended to optimise the security of credit, debit and cash card transactions and protect cardholders against misuse of their personal information. However, the transmission of information via the internet is not completely secure. So, whilst we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our Website. Any transmission is at your own risk. Once we have received your personal data we will use strict procedures and security features to prevent unauthorised access. Our internal processing takes place inside a VPN which is firewalled against the open internet and inside of which any kind of communication is processed in an encrypted way. As far as third parties (i.e. external companies) are rendering data processing services for us, we have committed them to the compliance with our data privacy regulations.

 

X. Your Rights

In respect of the collection and use of your personal data, you may:

  • withdraw your consent at any time for example by unsubscribing from the newsletter,
  • ask us whether we process Personal Data about you, for which purposes, the categories of Personal Data concerned, to which categories of recipients the information has been disclosed, where possible, the envisaged period for which the personal data will be stored (or, if not possible, the criteria used to determine that period),

We guarantee that no unauthorised persons are able to have access either to your profile or to your reservations,

  • object against the further processing and request erasure of your Personal Data,
  • request that the processing of your personal data is restricted by Mason’s Travel,
  • request not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you.

XI. Retention and deletion of Personal Data

We will retain your personal data only for a limited period of time needed to fulfil the purposes of processing mentioned above. After that time your personal data will be erased. If we process your personal data based on your consent we will retain your personal data for a limited period of time needed to fulfil the purposes of processing it.

Where we enter into a contract with you, we will keep your information for the duration of the contractual relationship you have with us, and, to the extent permitted, after the end of that relationship for as long as necessary to perform the purposes set out in this notice. The criteria to determine the storage period are statutory and contractual requirements, the nature of our relationship with you, the nature of the data concerned and the technical requirements. Laws may require us to hold certain information for specific periods.

Where we process personal data for marketing purposes or with your consent, we process the data until you ask us to stop and for a short period after this (to allow us to implement your requests). We also keep a record of the fact that you have asked us not to send you direct marketing or to process your data so that we can respect your request in future.

In other cases, we may retain data for an appropriate period after any relationship with you ends, to protect ourselves from legal claims, or to administer our business.

Terms & Conditions

Agreement between you and Mason’s Travel:

Mason’s Travel reserves the right to cancel or postpone an excursion due to bad weather, or if the minimum number of participants has not been reached.

Some excursions may include a wet landing. Mason’s Travel will not be held responsible for damage to clothing, electronic equipment or personal belongings during these landings. Clients are advised bring a bag to protect valuable items.

It is the client’s obligation to advise Mason’s Travel of any medical conditions, prior to confirming their booking. Our island-hopping boat tours are not recommended for pregnant women.

Parents must carry a copy of their *child’s ID during excursions. Failure to verify your child’s age on the day of the excursion will result in that child being charged as an adult.
*Clients between the ages of 2 years and 11 years, on the day of the excursion, are considered children.

 

By accessing and using the Mason’s Travel Website(s), you agree to accept, without modification, limitation or qualification, the terms and conditions contained herein (the “Agreement”). You represent and warrant that you possess the legal right and ability to enter into this Agreement and to use the Mason’s Travel Website(s) in accordance with all terms and conditions herein.

All tours on Mason’s Travel catamarans operate under a strict no-shoes policy. Clients are required to remove their shoes before boarding. Clients that refuse to comply with this policy will not be allowed to board our catamarans and will not be refunded for their tour.

 

Modification of Terms:

Mason’s Travel tries to ensure that the information contained in the Mason’s Travel Website(s) is as accurate as possible. However, inaccuracies may arise from time to time. Mason’s Travel accepts no responsibility for any errors in the information contained in the Mason’s Travel Website(s).

 

The Mason’s Travel Website(s) contain, inter alia, information about the products and services Mason’s Travel or a third party is offering. This information and all other material on the Mason’s Travel Website(s) are provided in good faith. By using the Mason’s Travel Website(s) you agree and acknowledge that Mason’s Travel may update, change or amend the Terms and Conditions and/or other information provided on the Mason’s Travel Website(s) at any time without advance notice.

Changed terms and conditions will become effective once posted on the Mason’s Travel Website(s), and will not have any retrospective effect on existing contractual arrangements made through Mason’s Travel Website(s). You should re-read these terms and conditions every time you visit the Mason’s Travel Website(s) to ensure that you aware of all the relevant terms and conditions. Subject to applicable law, under no circumstance is Mason’s Travel responsible for any direct or indirect, incidental, special, punitive, exemplary or consequential damages of any kind (including but not limited to lost profits, lost savings or revenue, or loss or corruption of data or information) which arises out of or is in any way connected with your use of or inability to use the Mason’s Travel Website(s) whether based on breach of contract, tort, negligence, product liability or otherwise, even if advised of the possibility of such damages.

This includes any information, products or services obtained through or any contract entered into via the Mason’s Travel Website(s).

 

Acceptable Use Policy:

When using the Mason’s Travel Website(s) you agree:

  • to use them solely to determine the availability of services offered by Mason’s Travel and to assist you to make legitimate reservations or transact business with us.
  • to use the Mason’s Travel Website(s)’ services to make only legitimate reservations;
  • not to make any false reservation or any reservation in anticipation of demand. not to deface, alter or interfere with the front end “look and feel” of the Mason’s Travel Website(s) or the underlying software code;
  • not to take any action which will impose an unreasonable or disproportionately large load on the Mason’s Travel Website(s) or related infrastructure;
  • to all of our terms and conditions of purchase, including, but not limited to, full and timely payment of all amounts due and compliance with all rules concerning availability of rates, products, or services. All fees, assessments, charges, taxes and duties arising out of use of the Mason’s Travel Website(s) are your sole responsibility;
  • not to do anything which will or might damage, interfere with, disrupt access to, interrupt or impair the functionality of the material available on the Mason’s Travel Website(s), nor to upload any material that contains any computer viruses or other codes, files or programs designed to interrupt, destroy or limit the functionality of any software or equipment;
  • not to post, distribute or otherwise upload any defamatory, libelous, offensive, infringing, obscene, indecent, harmful, threatening, abusive, tortuous, racially or ethnically objectionable or otherwise unlawful material or information or send any chain letters, junk mail, ‘spamming’ material or any other form of bulk communication;
  • not to threaten, harass, stalk, abuse, disrupt or otherwise violate the rights of others, including individuals’ privacy rights;
  • not to obtain or attempt to obtain unauthorised access to the Mason’s Travel Website(s) or any private or member account areas on the Mason’s Travel Website(s), nor to impersonate any person or misrepresent your affiliation with another person;
  • not do, cause or permit anything to be done that may infringe, damage or interfere with any intellectual property rights of Mason’s Travel nor any of our associated companies or third parties. Also, not to do anything that is otherwise unlawful or which may create any liability on the part of Mason’s Travel;
  • violate this Agreement or any applicable legislation in any other manner.

 

If Mason’s Travel considers that you have breached any of these terms and conditions or have otherwise demonstrated inappropriate conduct when using Mason’s Travel Website(s), Mason’s Travel reserves the right to:

  • warn you that you have breached these terms and conditions, and ask you to stop such conduct;
  • delete any material or content which you may have posted without notice to you;
  • take measures (including terminating, suspending or restricting your access) to, and preventing you from using the Mason’s Travel Website(s);
  • cancel any bookings that you may have with Mason’s Travel without reference to you;
  • report your activities to an internet service provider or relevant authorities;
  • take legal action against you.

 

Website Booking:

Your booking is subject to the applicable rate conditions and the availability of seats in a given tour/excursion. You need to pay online with a credit card.

You are only able to make amendments or cancellations on the booking you are making prior to confirming your reservation online. Any modifications after this must be made via communication with Mason’s Travel Contact Centre. You can contact us at [email protected]. All reservations, including modifications and cancellations are subject to the Terms and Conditions and any applicable fees and charges (including but not limited to bank charges).

Please note that your payment provider may apply different exchange rates to the fare displayed on the booking page. Therefore, there may be additional charges incurred, which Mason’s Travel is not liable for.

 

Use of Credit Card:

We accept all major credit cards. The credit card must be in the name of one of the tour participants and the same card must be carried at the time of the tour, together with the official proof of identity. Alternatively, if the cardholder is not participating in the tour, or if for any reason, the credit card used for the booking cannot be produced, Mason’s Travel may require that a clear photocopy of both sides of the credit card used for a booking may be presented, duly signed by the cardholder authorizing the use of the card for the purchase of the tour. For security reasons, we request you to strike out the Card Verification Value (CVV) code of the card on the photocopy.

  • Your credit card will be debited when you click on the check out button.
  • Disclaimer: Mason’s Travel accepts no liability or responsibility and will not be liable or responsible for any loss, damage, misuse or unauthorized access occurring in connection of with the provision of credit card data. Mason’s Travel will not be responsible or liable for any action or decision made by you in reliance on the information with regard to credit card usage on this website, even if Mason’s Travel has been advised of the possibility of these damages.
  • If the booking travel originates from some specific countries, the credit card used to make payment for this booking will be verified at the time of check-in.
  • Kindly note that Mason’s Travel is based in Mahe, Seychelles. It is possible that your credit card Issuing Bank may levy an additional fee for this transaction, for usage of the card in a foreign country. For further information, kindly contact your respective credit card Issuing Bank.
  • Mason’s Travel will charge your credit card in Euros, as displayed on the booking confirmation. Please note, your credit card Issuing Bank may levy a fee for transaction in foreign currency, and may also apply different exchange rate. Kindly contact your credit card Issuing Bank for further information on any fees and the applicable exchange rates.
  • For payments by VISA or MasterCard, depending on your credit card Issuing Bank, you may have to complete an extra level of security check through the “Verified by Visa” or “MasterCard Secure” page. A pop-up window will appear after you confirm the purchase of your tour(s), containing your bank’s logo, in which you must provide your ‘Verified by Visa’ or ‘MasterCard Secure’ password. This is not the PIN used for ATM/ Cash Machine transactions. If you are requested to enter this password, and if you have not registered for this authentication service, kindly contact your bank to register. If you are requested to enter this password and you choose to continue without entering it, or enter incorrect password, your booking may not be successfully completed. For further information, kindly contact your credit card Issuing Bank.
  • If your credit card is issued in India, we accept International Credit Cards.
  • Mason’s Travel reserves the right to cancel a booking in case of non-compliance with these credit card rules.

We will make every effort to maintain confidentiality when securing an online payment. This covers the security of your credit card details and other personal information. All of your personal information is encrypted as it travels over the Internet.

 

Indemnity:

As a condition of use of the Mason’s Travel Website(s), you agree to indemnify us from and against any and all liabilities, expenses (including attorney’s fees) and damages arising out of claims resulting from your use of the Mason’s Travel Website(s), including without limitation any claims alleging facts that, if true, would constitute a breach by you of these terms and conditions.

 

Links to Third-Parties’ Websites:

The Mason’s Travel Website(s) may contain links and pointers to internet sites maintained by third parties. Mason’s Travel does not operate or control in any respect any information, products or services on such third-party sites. Third-party links and pointers are included solely for your convenience, and do not constitute any endorsement by us. You assume sole responsibility for use of third-party links and pointers.

Choice Law & Jurisdiction:

Your use of the Mason’s Travel Website(s) and the Mason’s Travel terms and conditions is subject to the laws of the Seychelles and you agree to submit to the nonexclusive jurisdiction of the courts in the Seychelles. Mason’s Travel reserves the right to bring proceedings to the courts of the country of your location.
